SHOULDER INJURY COMPENSATION CLAIM - ACCIDENT EXPERTS

umbrella claims
A shoulder injury compensation claim usually arises from a road traffic accident or as a result of lifting heavy items or because of a heavy fall. The shoulder is a large ball and socket joint with heavy musculature and as such injuries can be severe and painful with debilitating long term effects. The most common injuries include :-
  • Sprains & Strains
This occurs when the muscles, tendons or ligaments are stretched or torn and usually results after several weeks or months of discomfort.
  • Dislocation
May involve nerve damage when the ball and socket joint separates. It is sometimes necessary to physically manipulate the joint back into union.
  • Rotator Cuff Injury
Damage to this group of muscles that hold this large joint together is extremely painful and can have long term disability problems.
  • Broken Collar Bone
This injury usually heals uneventfully over a period of weeks following immobilisation.

The value of an award in a shoulder injury compensation claim depends on the extent of the injury, the pain and suffering, the length of the healing period and whether or not there are any long term problems or disabilities. The most common and least severe injury is that of a sprain which can result from a fall, a sudden twist or a blow to the body which forces the joint out of its normal position. This can result in stretching or tearing of the ligament supporting that joint. Typically, sprains occur when people fall and land on an outstretched arm. For a minor sprain/soft tissue injury, damages are likely to be awarded in the range of £2,000 – £5,000. More serious injuries including frozen shoulder and dislocation can attract damages in the region of £5,000 to £25,000 with severe non resolved rotator cuff injuries exceeding those figures.

Most of these injuries occur as a result of a sudden trauma such as a car accident, a slip or a fall or during heavy lifting. In many of these instances it may be possible to start a shoulder injury compensation claim due to the fact that the incident that caused the injury may have been the fault of or may have been contributed to by a negligent third party. The limitation period for personal injury does apply in these claims and the matter should either be settled or proceedings must have been issued within three years of the event causing the injury failing which the opportunity to claim compensation may be lost forever. The three year period does not start running until a minor victim attains the age of 18 years and for the mentally ill or those suffering from mental disability time may never start to run. The court has a wide discretion in these matters.
