A brain injury compensation claim can arise as a result of a large number of different types of accident from tripping and slipping, car accidents, injuries at work, sports injury and falls from height. Serious injury can be deceptive and the brain can be severely damaged with no outward sign of injury. If the head receives trauma that is not sufficient to break the skin and cause bleeding it can nevertheless be sufficiently serious to cause the brain to be battered around inside the skull causing bleeding, haemorrhage and bruising. These ‘closed’ injuries can be amongst the very worst brain damage.
A brain injury compensation claim generally follows one of the three main categories of injury which are as follows :-
Closed Head Injury
This most often occurs as a result of sudden motion of the head without contact or with minimal contact against a hard surface. It occurs in rapid acceleration/deceleration situations and can produce massive internal damage to the brain caused by the brain rocking about within the skull and colliding with the surface of the skull. A closed head injury can involve the scalp being split.
Open Head Injury
This is a more traumatic injury and is categorised in this way when the skull is breached and the brain is exposed. Surprisingly this can be a less serious situation than a closed head injury. The scalp being lacerated and bleeding does not qualify as an open head injury.
Crush Injury
This occurs most often when the nerves of the brain stem at the base of the brain sustain a crushing injury. This may be extremely serious although there may be no loss of consciousness.
Dependent on the extent of the injury, the time taken for recovery and whether or not there are long term consequences, an award in a brain injury compensation claim can run into millions of pounds particularly if there is substantial loss of wages or a long term care element. Even a modest blow to the head can result in the development of epilepsy (£28,000-£77,000) or in severe loss of memory and intellectual deficit (£22,000-£77,000). Even the most minor injury can result in personality change, poor concentration or depression (£8,000-£22,000) or even cause debilitating headaches (£1,000-£6,000).
